General terms and conditions of purchase

When you visit or make a purchase at the Miss Mary of Sweden webshop www.missmary.com (hereinafter called Miss Mary) you are covered by our purchase and user terms and conditions. It is therefore important that you read through the user terms and conditions carefully before you use the website. Use of the website and/or ordering via the website means that you approve these purchase and user terms and conditions. Miss Mary reserves the right to change these terms and conditions. If the terms and conditions have been changed after you have placed an order, it is the terms and conditions that were published at the time the order was placed that are applicable.


In the event that Miss Mary's website contains links to a third party, or material from Miss Mary is published by third party, Miss Mary cannot be held liable for any damage or loss that may arise in conjunction with use of the information in question as Miss Mary lacks control over the content of these websites.


All references in these terms and conditions to "Miss Mary of Sweden", "Miss Mary", or "the webshop" refer to Miss Mary of Sweden OÜ, company registration number 10194063, Mahtra 30C, Tallinn, Harju 13811, Estonia.

Processing of personal data

The Parent Company, Miss Mary of Sweden OÜ, is responsible for processing your personal data and ensuring that it is processed in accordance with current legislation according to Directive 98/48/EC. Miss Mary can provide partners with information or when information is required by public authorities in accordance with legislation in force from one time to another. For complete information about how we process personal data, reference can be made to the Personal Data Policy "Processing of Personal Data"


You are entitled once a year, free of charge, to receive information about how your personal data is used. If you would like this information, you must submit a written request to us. If you would like to change your personal data or notify us that you do not wish to receive advertising mail,

Purchases

Orders to Miss Mary can be placed via the webshop. In Sweden, Norway and Finland, orders can also be placed by telephone or using a written order form. To place an order with Miss Mary, you must be over the age of 18 and be resident in one of the countries where we deliver, which at present are all the EU countries and the USA. The order must be placed via the webshop for the country in which the consignee is resident, or for persons who are resident in the EU, via the joint EU webshop www.missmary.com


The customer must provide a delivery address and contact details. The easiest way to provide these details is by registering as a customer on our website or using our checkout process at the webshop. The purchase is not completed until the order has been picked at our warehouse and you have received information that your consignment is ready for delivery.

Agreement and order confirmation

When you place an order with Miss Mary, an agreement is entered into when Miss Mary confirms that your order has been packed and is ready for delivery. A copy of this order confirmation is then sent to the customer by e-mail. It is our ambition to confirm your order as soon as possible. If you place an order on a weekend or a public holiday, our aim is that your order will be processed before 6pm on the next ordinary working day.

Discounts and offers

Miss Mary sometimes has different discounts and offers as part of its marketing. If you have a discount code, you must enter the code in the discount code box. Note: it is only possible to use discount codes for goods sold at the normal price and a discount code can only be used once on each occasion. Discount codes may only be used once per household. Miss Mary is not responsible for offers or discount codes that are published anywhere else other than in Miss Mary's own newsletter, catalogues or webshop.

Payment

A handling and freight fee of is added to all shipments, except for backorders. You will only be charged once per order for delivery regardless of how many separate shipments we send to you. If an item is temporarily out of stock, the week it is expected to be available for shipment will be shown on our website. If no "delivery date" is given for the out of stock item, you can expect delivery within the next 30 days.


When you purchase from Miss Mary you can choose between the following payment methods:


Credit card – We accept VISA and MasterCard.
3D-Secure technology has been developed by VISA and Mastercard, and aims to identify cardholders for online payments. The identification process is much the same as that used at ATMs and is based on a personal code/password being used in conjunction with the purchase. This technology means that the cardholders can be certain that their cards are not being used by unauthorised individuals.


Klarna’s payment methods
Together with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options, with payment made directly to Klarna.


• Payment within 14 days: The payment time is 14 days from the dispatch of the items. The terms and conditions of payment within 14 days can be found here.
• Account: Klarna Account is credit provided by Klarna that allows the borrower to part-pay his/her purchases.
• Klarna direct: Our card payments are handled by Klarna payment services and are licensed for 3-D Secure (Verified by Visa and MasterCard SecureCode) and certified according to PCI DSS. They comply with the banks’ requirements for confidentiality and security certifications.

Paypal
We accept payment by card via PayPal. You will automatically be forwarded there during the order process. If you are already a PayPal customer, you can log in with your user information and confirm the payment. If you are new to PayPal, you can either log in as a guest or create a PayPal account and then confirm the payment. If you return an item, the amount will be refunded to your PayPal account.

Miss Mary offers the following delivery alternatives:


Delivery by post to Australia – You pay just $ 7.99 to have your order sent to your home by mail. Delivery takes place up to 15-25 business days after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. In the case of parcels that cannot be placed in the mailbox, you will receive notification that the parcel is available for collection at a collection point.


Express delivery to Australia – If you want your order delivered quickly, we can offer express delivery using DHL at a cost of $ 29 The parcel is delivered to your home address via a DHL courier within 3-4 days of confirmation of your order.


Delivery by post to Canada – You pay just $ 7.99 to have your order sent to your home by mail. Delivery takes place up to 3 weeks after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. In the case of parcels that cannot be placed in the mailbox, you will receive notification that the parcel is available for collection at a collection point.


Express delivery to Canada – If you want your order delivered quickly, we can offer express delivery using DHL at a cost of $ 22,90 The parcel is delivered to your home address via a DHL courier within three days of confirmation of your order.


Delivery by post to Ireland – You pay just € 4,50 to have your order sent to your home by mail. Delivery takes place 7-9 business days after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. In the case of parcels that cannot be placed in the mailbox, you will receive notification that the parcel is available for collection at a collection point.


Express delivery to Europe – If you want your order delivered quickly, we can offer express delivery using DHL at a cost of 14 EUR The parcel is delivered to your home address via a DHL courier within three days of confirmation of your order.


Delivery by post to New Zealand– You pay just $ 8.99 to have your order sent to your home by mail. Delivery takes place within 15-25 business days after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. Delivery by post to the UK – You pay just £3.50 to have your order sent to your home by mail. Delivery takes place 7-11 business days after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. In the case of parcels that cannot be placed in the mailbox, you will receive notification that the parcel is available for collection at a collection point.


Express delivery to the UK – If you want your order delivered quickly, we can offer express delivery using DHL at a cost of £ 10.00. The parcel is delivered to your home address via a DHL courier within three days of confirmation of your order.


Delivery by post to the USA – You pay just $5.99 to have your order sent to your home by mail. Delivery takes place within 8-15 business days after we have confirmed your order. All parcels sent by post are sent as first class letters. If the size of the parcel permits, the parcel will be placed in your mailbox. In the case of parcels that cannot be placed in the mailbox, you will receive notification that the parcel is available for collection at a collection point.


Express delivery to USA – If you want your order delivered quickly, we can offer express delivery using DHL at a cost of $ 16,90. The parcel is delivered to your home address via a DHL courier within three days of confirmation of your order.

Right to cancel a purchase, returns and replacements

By law, you have 14 days during which you have the right to cancel a purchase. At Miss Mary you always have 100 days during which you have the right to cancel a purchase and the right to return the goods. In the case of replacement or return, send the goods in the same condition that they arrived. Always complete the enclosed return slip. The goods can be returned in the same bag in which they were delivered. Do not forget to pay the postage. If you wish to cancel your purchase or if you wish to make a change, you are responsible for the return freight. The right to return goods or replace goods naturally does not apply if the goods have been used.


If the goods are faulty or have been sent incorrectly, we are responsible for the cost of the return freight. In that case contact our Customer Service Department for further instructions. If you have any questions about your return, you can contact our Customer Service Department here.


In the case of a return, we will refund your money within 14 days of being notified of the return, although not until the goods have been received and checked by us.


Shipping and handling fees are not refundable.


If you paid with Klarna and are returning an item:
Did you know that you can pause your invoice by logging in on Klarna.com or the Klarna app? Go to the relevant order and click on ‘Report return’. Your invoice will then be paused automatically until we at Miss Mary have received your return. If you’ve returned part of an order, you’ll receive an updated invoice for the items you’ve chosen to keep.

Claims

We are grateful for your help in pointing out any faults in the goods. If you have any comments regarding the goods that are delivered and if you wish to make a claim, please return the goods to us as soon as possible. If the claim refers to goods that have been used, please contact our Customer Service Department for further instructions. Claims for used, unwashed garments will not be processed.

Force Majeure

Miss Mary is not liable for delays caused by circumstances over which Miss Mary had no control, such as general labour disputes, war, fire, lightning, terrorist attack, a change in an official decision, technical problems, faults in power supply/telecommunications/data links or any other form of communication as well as faults or delays in services by a sub-supplier as a result of any of the aforementioned circumstances. These circumstances shall constitute grounds for discharge from liability, which entail exemption from liability for payment of damages and other sanctions.


In the event of a dispute, reference is always made to the National Board for Consumer Disputes. Miss Mary always follows the recommendations of the Board.
